Parentage Orders
We work diligently to ensure a successful surrogacy, from the execution of contracts to obtaining an Indiana pre-birth parentage order. When you come to our office, we will take the time to answer all of your questions, explain the process and clear up any aspect of the surrogacy process that might be confusing.
After the gestational surrogate and Intended Parents execute their gestational surrogacy agreement and a successful pregnancy is achieved, the next step is for the Intended Parents to start the process of establishing legal parentage of the child that will be born to the surrogate. This is a necessary step because the surrogate and her spouse, if married, will be presumed to be the legal parents of the child. Without a court order instructing otherwise, the surrogate and her spouse, if married, will be placed on the child’s initial birth certificate, make medical decisions for the child and will be asked to take the baby home from the hospital. As obviously this is not in line with the intentions of the gestational surrogate and Intended Parents, a parentage order should be obtained.
